ARTICLE 2- THE SUBJECT

3.3- ON THE OTHER HAND, SINCE TERM SALES ARE MADE ONLY WITH CREDIT CARDS BELONGING TO BANKS, THE BUYER AGREES, DECLARES AND UNDERTAKES THAT HE WILL CONFIRM THE RELEVANT INTEREST RATES AND INFORMATION ABOUT DEFAULT INTEREST SEPARATELY FROM HIS BANK, THAT Decrees RELATED TO INTEREST AND DEFAULT INTEREST WILL BE APPLIED WITHIN THE SCOPE OF THE CREDIT CARD AGREEMENT BETWEEN THE BANK AND THE BUYER IN ACCORDANCE WITH THE PROVISIONS OF THE LEGISLATION IN FORCE.
RETURN PROCEDURE:
A) REFUND PROCEDURE TO CREDIT CARD
In cases where the BUYER exercises the right of withdrawal, or the product subject to the order cannot be supplied for various reasons, or in cases where it is decided to refund the price to the Consumer by Arbitral tribunal decisions, if the purchase was made by credit card and in installments, the return procedure to the credit card is indicated below:

The refund to the credit card will be made by the Bank in accordance with the above procedure after the SELLER has paid the price to the Bank in one go.
The BUYER acknowledges and undertakes that he has read and accepted this procedure.

PAYING PAID AT THE DOOR IS THE REFUND PROCESS IN THE MONEY TRANSFER/EFT PAYMENT OPTIONS. B)
Pay paid through the door In the Money Order / EFT payment options, the refund will be made in the form of a Money Order or EFT to the account specified by the Consumer by requesting bank account information (it is necessary that the account is in the name of the person at the billing address or in the name of the user member).

ARTICLE 4- GENERAL PROVISIONS

4.2- THE PRODUCT SUBJECT TO THE CONTRACT IS DELIVERED TO THE BUYER OR THE PERSON / ORGANIZATION AT THE ADDRESS INDICATED ON THE WEBSITE WITHIN THE PERIOD DESCRIBED IN THE PRELIMINARY INFORMATION, DEPENDING ON THE DISTANCE OF THE BUYER’S SETTLEMENT FOR EACH PRODUCT, PROVIDED THAT IT DOES NOT EXCEED THE LEGAL 30-DAY PERIOD.
4.3- IF THE PRODUCT SUBJECT TO THE CONTRACT IS TO BE DELIVERED TO A PERSON /ORGANIZATION OTHER THAN THE BUYER, THE SELLER CANNOT BE HELD RESPONSIBLE FOR THE FAILURE OF THE PERSON / ORGANIZATION TO BE DELIVERED TO ACCEPT DELIVERY.
4.4- THE SELLER IS RESPONSIBLE FOR THE DELIVERY OF THE PRODUCT SUBJECT TO THE CONTRACT IN A SOUND, COMPLETE MANNER, IN ACCORDANCE WITH THE QUALIFICATIONS SPECIFIED IN THE ORDER AND WITH WARRANTY DOCUMENTS AND USER MANUALS, IF ANY.
PAID PAID BY THE BUYER’S PREFERRED PAYMENT METHOD 4.5- FOR THE DELIVERY OF THE PRODUCT SUBJECT TO THE CONTRACT, IT IS NECESSARY THAT THE SIGNED COPY OF THIS AGREEMENT HAS BEEN DELIVERED TO THE SELLER AND THE PRICE HAS BEEN PAID BY THE BUYER’S PREFERRED PAYMENT METHOD. 4.6- IF THE BANK OR FINANCIAL INSTITUTION RELATED TO THE UNFAIR OR UNLAWFUL USE OF THE BUYER’S CREDIT CARD BY UNAUTHORIZED PERSONS IN A WAY THAT IS NOT CAUSED BY THE BUYER’S FAULT AFTER THE DELIVERY OF THE PRODUCT DOES NOT PAY THE PRODUCT PRICE TO THE SELLER, THE PRODUCT MUST BE SENT TO THE SELLER WITHIN 3 DAYS, PROVIDED THAT THE BUYER HAS DELIVERED IT TO HIM.
4.7- DEFECTIVE OR DEFECTIVE PRODUCTS, WITH OR WITHOUT PRODUCTS SOLD WITH A WARRANTY CERTIFICATE, CAN BE SENT TO THE SELLER FOR AUTHORIZED SERVICE TO MAKE THE NECESSARY REPAIRS UNDER THE (DEFECTIVE) WARRANTY TERMS, IN WHICH CASE THE SHIPPING COSTS WILL BE COVERED BY THE SELLER.
ARTICLE 5- RIGHT OF WITHDRAWAL
The BUYER has the right to withdraw by rejecting the goods within 7 days from the delivery of the product subject to the contract to him or to the person / organization at the address he /she has indicated. The product price will be refunded to the BUYER within 10 days from the date of receipt of the consumer’s withdrawal notification to the SELLER.(see Article 9/2 of the Regulation on Distance Contracts) The shipping cost of the returned product due to the right of withdrawal is covered by the SELLER.
We undertake that the consumer has the right to withdraw from the contract by refusing the goods or services within seven days from the date of receipt of the goods or signing of the contract without assuming any civil or criminal liability and without any justification, and to return the goods from the date of receipt of the withdrawal notification to the SELLER or provider.

ARTICLE 2 – SUBJECT
The subject of this agreement is the sale and delivery of the product, which the BUYER has ordered electronically from the SELLER’s website (https://patchdunyasi.com), including the product’s specifications, sales price, and related terms, in accordance with the provisions of Law No. 4077 on the Protection of Consumers and the Regulation on the Implementation of Distance Contracts.

ARTICLE 3 – SUBJECT PRODUCT
3.1. The type, quantity, brand/model, color, and the sales price (including VAT) of the product are as follows:

3.2. Payment Method: Single Payment via Credit Card

Return Procedure:

  1. A) CREDIT CARD RETURN PROCEDURE
    In the case that the BUYER exercises their right of withdrawal, or if the product cannot be supplied for any reason or is subject to a decision to refund by the Arbitration Board, the procedure for credit card refunds is as follows:
    If the product was purchased with installments, the bank will refund in installments. After the SELLER makes a full payment to the bank, the refund will be processed in the same way as the installments were paid.
  2. B) RETURN PROCEDURE FOR COD AND BANK TRANSFER/EFT PAYMENTS
    For COD and Bank Transfer/EFT payments, the refund will be made through a transfer to the consumer’s bank account (under the name of the person on the invoice or registered user) via Bank Transfer or EFT.

The delivery will be made by the cargo company (ARAS) to the BUYER’s address. In case the BUYER is not present at the address upon delivery, the SELLER is considered to have completed the delivery. If the product is delayed or returned by the cargo company, the costs incurred will be borne by the BUYER.
Shipping Fee: 10,00 TL, added to the total order amount, payable by the customer. This fee is not included in the product price.

ARTICLE 4 – GENERAL PROVISIONS
4.1. The BUYER declares that they have read the basic characteristics, sales price, payment method, and delivery information of the product on the website (https://patchdunyasi.com) and have confirmed this electronically.
4.2. The product will be delivered to the BUYER or the designated person/institution within the time frame specified on the website, depending on the distance to the BUYER’s place of residence, but not exceeding the legal 30-day period.
4.3. If the product is to be delivered to someone other than the BUYER, the SELLER is not responsible if the recipient refuses to accept delivery.
4.4. The SELLER is responsible for delivering the product in good condition, complete, and in accordance with the specifications mentioned in the order, along with any guarantee certificates and user manuals.
4.5. This contract must be signed and the product payment must be made as per the chosen payment method in order for the product to be delivered. If the payment is not received or is canceled by the bank, the SELLER is not obligated to deliver the product.
4.6. If the BUYER’s credit card is used by unauthorized persons without fault from the BUYER’s side, and the bank refuses to pay the SELLER, the BUYER is required to return the product within 3 days, provided it has been delivered.
4.7. If the product is defective or faulty, it can be sent to the SELLER for repair according to the warranty conditions, with shipping costs borne by the SELLER.

ARTICLE 5 – RIGHT OF WITHDRAWAL
The BUYER has the right to withdraw from the contract within 7 days from the delivery of the product without any legal or criminal responsibility, and without needing to provide a reason. The product price will be refunded within 10 days after the SELLER receives the withdrawal notice. The shipping cost for returns will be borne by the SELLER.

ARTICLE 6 – PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE USED
Products that cannot be returned due to their nature include single-use items, copyable software and programs, perishable goods, or items past their expiration date. The right of withdrawal applies only if the product has not been opened, damaged, or used.
Examples of products for which the right of withdrawal cannot be used:

  • Portable and Desktop Computers (once the system is installed, returns are not allowed)
  • Software and Programs
  • Custom-designed products (name badges, logos, personalized items)
  • Office supplies (toner, cartridges, ribbons, etc.)
  • Cosmetics
  • Mobile phone credit orders
  • Health-related products (e.g., earphones)
  • Perishable goods or items past their expiration date.

ARTICLE 7 – DEFAULT PROVISIONS
In case of default by either party, the relevant provisions of the Turkish Civil Code Articles 106-108 on Default will apply. If one party fails to fulfill their obligations, the other party may grant a 10-day period for performance. If the defaulting party does not fulfill their obligations within that period, the creditor can demand the delivery of the product, the termination of the contract, and/or the refund of the paid amount.

ARTICLE 8 – COMPETENT COURT
In the case of a dispute, the Consumer Arbitration Committees and Consumer Courts of the BUYER’s or SELLER’s place of residence, as determined by the Ministry of Industry and Trade, will have jurisdiction.
By placing an order, the BUYER accepts all the terms of this agreement.
